copy contain to still be recognisable as a "logical image" of the original?
Between the (only theoretically possible) identical reproduction and the derived work that is still just recognisable as a copy, the creator has a certain amount of leeway.
To what degree the use of this creative leeway represents a violation of the protected, proprietary, intellectual creation is not a question of
logic but instead a matter of
discretion of the courts.
